3. Subscriptions, billing, and renewals

• Paid plans are billed in advance on a recurring (for example, monthly) basis until cancelled.
• By subscribing, you authorize us and our payment providers to charge your payment method for each billing cycle.
• Subscriptions renew automatically unless cancelled before the renewal date.
• We may change plan prices or features; we will give reasonable notice of material changes, which apply from your next billing cycle.
• Cancellations and refunds are governed by our Refund & Cancellation Policy.

4. Acceptable use

You agree not to use the Service to create, upload, or distribute content that:

• Is illegal or promotes illegal activity;
• Infringes the intellectual property, privacy, or other rights of any person;
• Sexually exploits or endangers minors in any way (strictly prohibited);
• Is hateful, harassing, defamatory, or incites violence;
• Is deceptive or fraudulent, impersonates others, or spreads misinformation;
• Contains malware or attempts to disrupt or gain unauthorized access to the Service.

We may suspend or terminate accounts that violate this policy.

5. Your content and ownership of generated images

• You are responsible for the prompts you submit and the images you generate.
• Subject to your compliance with these Terms and your active plan, you may use the images you generate, including for commercial purposes where your plan grants a commercial license.
• Because of how AI works, similar prompts may produce similar results for different users, and we cannot guarantee that any output is unique or free from similarity to other works.
• You are responsible for ensuring your use of generated images complies with applicable laws and third-party rights.

6. Our intellectual property

The Service, including its software, design, branding, and content (excluding the images you generate), is owned by Generate AI Images and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

7. Third-party services

The Service may rely on or link to third-party services such as payment processors and AI infrastructure providers. We are not responsible for third-party services, and your use of them may be subject to their own terms.

8. Disclaimers

The Service and all generated content are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that output will meet your expectations or be accurate, appropriate, or fit for any particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, Generate AI Images will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold harmless Generate AI Images from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or any law or third-party right.

11. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or for operational, legal, or security reasons. Upon termination, your right to use the Service ends.
